All Delivered-Breach of Contract, Failure to Deliver
We have a contract that our clients sign. The contract is very simple to read and spells out everything they need to know about the delivery process. As far as our workers go, they also sign a contract. They are given clear instructions about what they are to do and not to do. In those cases where people say they have not been paid or paid in full, they have not turned in the required paperwork or even a correct mailing address, despite the fact that we make every effort to train them to use our paperwork the GPS units. It is no surprise that those who submit incomplete or illegible information, or bad contact information, cannot get paid. People who turn in the required paperwork and return the GPS units are paid. We have found that the majority of complaints come from people who have breached the terms and conditions of their contract by throwing away print, not delivering according to instructions, and are just irritated that we will not let them get away with it.
Regarding GPS units, we know that occasionally they may malfunction. However, in those cases we instruct people to take pictures with their cellphones and stay in touch with their project managers. We have found that in very few cases where a worker has said that their GPS unit did not work, the number of pieces which they allege to have delivered far exceeds the amount even our most seasoned workers have been able to distribute in the same amount of time. Therefore it is not unreasonable to determine that their numbers are suspect and improvable when it appears as though personnel are attempting to hide the truth behind “so called” malfunctioning GPS units. We make every effort to help our clients and workers understand everything in the delivery process. If they choose to ignore or defy the system, the consequences are on them, not on us.
Regarding the comment by “youknowhow I am” about the driver who went missing, I find it quite insensitive. The driver is/was reliable and worked incredibly hard. If you did research behind the matter you would find that a missing person’s report was filed by the driver’s family.
