Illegal Practices and Consumer Harrassment

My loan was sold to Santander a year ago and my payments were taken out of my bank account through auto pay. I did not have a problem until this month which was supposes to be my last payment(deferred). I called and was told that my auto pay was disabled and that I would have to send my last payment by money order or bank check .I sent a money order out on 12/27/11 and this morning noticed that the auto pay went through anyway and it overdrew my bank account. I am now waiting for Santander to reimburse my account and if that doesn't happen I will be contacting an Attorney.

After reading for hours about Santander I am not surprised. Our situation is different. My husband was deployed to Iraq when we got behind on payments and also when HSBC transferred our loan to Santander. Upon his return he called them up and tried to make arrangements, he was told that they had charged off the loan, but as a courtesy they would allow us until Dec. 2011 to come up with the 15, 000.00 we still owed. Mind you we'd already made 52 payments at 675.00 a piece. Pretty certain we've paid our share. Anyway. We knew we wouldn't be able to come up with that, we were behind on everything. Surprisingly the Army doesn't pay as well as civilian IT work does. We ended up having to file bankruptcy in March of this year. We have not heard a word from Santander in over a year. When we were in the bankruptcy process we tried to re-affirm with them and they refused, reiterating that we could pay the full amount by December or they'd get the car. They LET us keep the vehicle until 12/19/11 at which point a man showed up at the door, identified himself as being there to collect the car for Santander, had our name, address and balance on a clip board. We didn't argue, we simply gave him the keys and he allowed us to get our belongings out of the car. The very next day Santander called to "inquire our intentions with the vehicle", mind you first of all we filed bankruptcy and it's a violation of law for them to call us at all since that debt was included and discharged, secondly we hadn't heard a word from them up to this point. I informed the lady that they had taken the car the day prior and she said, ok, maybe they just haven't reported it. We have since been called three more times. Wednesday 12/28/11 after talking to a third representative I was told to hold while they checked to see if they'd put out an order on the car, heard her mumble something about something being done on the 17th and then she came back to the phone and said NO we didn't get the car, someone stole it from you, you need to file a police report and call us back with the report number. I hung up and did this immediately, the lady at 911 chuckled when I informed her that Santander told me that the police department would find out if it was truly repo'd or stolen, she then put me on hold to check if it had been reported to them as repo'd and it had not. They called again today and my husband told them to stop or he'd call the lawyer. I decided not to wait until they did it again and I emailed our attorney. Not only did she say they are not to contact us, but if they were going to recover the car due to bankruptcy they had to go through her office to do so. She told me to call them back and give them her contact information. I called them back and talked to some guy named James who appeared to know exactly who I was when I gave him my name. He argued with me for 30 minutes about the law. He told me that it was MY car and it was stolen so I should be very concerned and I told him that since the debt was discharged in the bankruptcy that I pretty much wasn't all that concerned. They still hold the lien. I then told him I'd just have my attorney contact them and he can tell her about the laws in the state of Oklahoma since he knows them so well. Basically, Santander has my car, but is telling me they do not, that someone knew all of our information and walked up to the door, knocked and asked for the keys which we surrendered to them no questions asked. I asked the tow truck guy if there were any papers to sign. He said no, why would I question that? Considering Santander started calling the following day I find it hard to believe that they have no knowledge of my car being repossessed. I assume they are trying to get a claim out of my insurance company or gap protection, however I called and cancelled my insurance the moment the man left, my insurance agent recorded the time as 4:55 PM on the 19th. She informed me that even IF they try to file a claim that it won't be paid since I was told that Santander now had possession of the car, they have to worry about it. The police man came out and took all of the information and had a good laugh at their story as well. I've received one call from the OKCPD asking me for their contact number, they said that since I gave them my keys it technically wasn't stolen. I don't know what they told the investigator, but they still called back today. I'll be calling tomorrow to find out if the OKCPD has found out anything and waiting on our Lawyer to email me what she finds out. Basically, IF someone shows up to get your car, get their name, number, business card and the tag on the wrecker because if not, Santander will tell you it wasn't them and try to extort your insurance company for the money you owe. So moral of the story, Santander has resorted to car theft now as a means of trying to get money from a debt that was discharged in a bankruptcy. Our bankruptcy was finalized in June, why did they not come get their property at that time? I'm a little stressed because I'm not sure what they will pull now, but they underestimated my ability to contact legal help and he acted like he didn't believe me when I told him what the lawyer said. I guess when she calls him tomorrow he'll realize I was serious. Here's hoping they find my beautiful midnight blue dodge charger RT in tact, because if they don't then they suffer. I have since purchased a vehicle to replace it, so I'm not desperate for it back. I would have preferred they repo'd it in June and should have listened to my husband when he said we should have just called them up and asked them where to take it. So yeah. They have violated federal bankruptcy laws by contacting us about the car at all, and at the very least have committed fraud and/or car theft. I feel sorry for the poor repo guy when they find the car on his lot and he finds out he stole it. I told the guy on the phone that it will turn up eventually and when it does I'll let him know where he can recover his car from. He seemed pretty certain it wouldn't. We'll see.

Well its about time that somebody did something about Santander Consumer's sorry behind. I hope they are left with nothing when it is all said and done. After reading some of the comments, I must agree with most of them. This company is right out vicious, manipulative, rude, disrespectful and use of under handed tactics when they place a call to you. Ranging from area codes from 704, 719, 619, unknown, etc., and the will call and harass you from 0800 am till 9:00 pm; continuously all day. I have a direct deposit going to them, and I still got harassment telephone calls. It came to the point where I had to ignore calls on my cell phone. How do someone be late with a car payment and you have direct deposit. They go through First Citizen Bank, and they in turn sends out a check to Santander Consumers on the first of every month. Okay, that's the main reason I started the direct deposit so that the company would get the payment on time. It actually gave me a headache when I had to deal with them. I literally had to tell them to come and get the car & that I wanted my deposit and all the payments that you have received thus far. The harassment is not worth it. Yes, with the economy the way it is, people losing their jobs and it's basically rough out there. I really don't believe that a consumer would intentionally not want to make their car payments. At least I don't. I want to establish good credit and pay my bills on time. I found that allotments & direct deposits are easier for me. It's really frustrating when you are harassed for a payment and it shows on your pay check stub that the money was taken out. Total unprofessional at times some of the callers were, and I would never refer that company to anyone. I can attest that interest is very high and it does appear that you make a payment, and your balance seems to never move no more than a couple of dollars.

Santander USA is very un ethical in their practices, they constantly harass you even after you have made a payment. I am soooo upset at this company i have paid my car off but acording to the high interest rates i still owe them, its a shame that they let these companies take advantage of people.I am also filing a complaint with the BBB!

I agree this company is a big rip off. I financed my car for 6 years with another company and then santander took over the loan. Now I look at my balance it's barely dropped. I have had a few deferrments done over the 6 year period for a total of 6. So now Im thinking all I have to do is pay 6 months extra of payments or 7 at the most. How about this company tells me I will still have to pay off 3, 000 plus dollars in interest charged. I was pissed and told them that was not correct. There is no way Im paying 354.00 on this car for another 12 months or so. The car has almost 200, 000 miles on it. They are the biggest crooks ever. I have had other car loans in the past and have deffered a payment or two and have paid it off as I should. I hope they get what they deserve

am so feed up with santander they took over my loan from another loan company who sold this company my loan with out me knowing this santander company have called everyone who i put down for reference and gave out all of my privacy called my job numerous of times towed my car and damage my vehicle told me about the damage after i came to pick up my car from 6 hours away from home towed my car out the auction on a wrecker truck and told me i had a busted oil pan and they did not know what happen to my car but was willing to tow it to a repair shop i called santander and they told me i need to get and touch with the auction they had nothing to do with this but charge me 400 dollars for repo and 150 dollars for storage fees it took 1 month for me to get and touch with towing company after towing company santander told me my loan would be and the office of the president to the situation was resolve and i would not get any phone call that was a lie i am just feed up with these company there just a much of crooks
