deceptive business practices

Very dodgy company. We are from the UK and really got the hard sell in Whistler. It goes like this.
They invite you, YOU pay $20 which you get back, and some sales rep gives you the pitch. They tell you about every place you could visit using your 'points' exchanged as dollars. Its not an investment, they tell you about the losses you can make but then pile on the smoke and mirrors scam with dubious math calculations. Points buys you 'real estate' is the scam. They insist on showing you a made up room. This could be his hotel room for all we know. What difference does it make to show us a room if we are going to use the points in 100's of locations around the globe? Then the sales pitch...
$30, 000 for 125 points. Right...we look not interested. The the offer of a free 1 week holiday and cash back...$20, 000. Then he leaves the room talks to his boss and they can offer more points for the same money.

Then the boss. Thanks for coming. We'd really like you to buy today. This file is closed when you leave and is not open for the same offers at any other time. WELL IF ITS SO BLOODY GOOD I'LL BE BACK WHEN I'VE HAD A CHANCE TO THINK ABOUT IT. But no... then they offer a free 1 week holiday in THIS resort if you sign up today, and if you do we don't take a 10% deposit, NO, not even a $1000 deposit, NO... for you only today $200 if you sign your life away at this very moment in time.
Really uncomfortable hard sell tactics. We saw sense and walk away with the promised $175 voucher.

What really concerns me is their business model. 125 point bought by us today a week anywhere. We can hand these points to our children, our grandchildren, their grandchildren for generations... this will effectively be a free 1 week holiday anywhere in the world FOREVER. I don't care who you are but that pack of cards will eventually crumble and everyone is going to loose the investment they are promised...real estate. This is truly a scam that Canada is going to never live down... its growing and the media frenzy when it falls will be huge.

Stop Telling Lie

On Feb. 14th, Me & my wife entered into contract with Intrawest ULC, purchased 125 resort points for a contract amount of $28,943.13. The 125 Resort points we purchased will be available for use not until April 1st, 2015. These resort points can be use to stay with their properties worldwide. We gave C$1,000.00 paid thru our credit card on Feb. 14th and after 10 days they charged again C$2,540.63 with the same credit card to complete the 10% down payment for a total of C$3,540.63. As agreed, balance would be under their company financing for 10 years and 1st monthly amortization is on May 1st, 2015. During the presentation on Feb. 14th we told the Salesman, we still want to review and check our financial capacity but the Salesman insisted we will not lose anything if we signed today and give us assurance for a verbal collateral agreement that we can cancel anytime the contract & refund our 10% downpayment as long as we have not paid yet the 1st monthly payment for the remaining 90% of contract price, that prompted us to proceed & signed the written contract.
On February 28, 2015, a representative of Intrawest ULC called us to give us orientation on how to get access our account on-line. After few minutes of going through with Club Intrawest website, we realized, they only have limited properties worldwide and needs to pay additional fees to use other properties that they are affiliated with, which we totally overlooked during presentation. That's why we told the Representative to hold the orientation that day and we need to do some research about this membership. Upon reviewing further with our financial status and with a bad news we got from our family in the Philippines requiring huge financial help, we concluded to cancel the contract with Intrawest ULC due to following reasons:

We would not benefited much and just waste of money for us as we will not go on vacation regularly
Maintaining our membership would cause us financial burden in the future
We still have other priorities that require our financial standing

On the next day, March 1st, 2015, we contacted Intrawest ULC thru email, informed our decision to cancel our membership and want to rescind the contract but to our surprised, they said 7 days cancellation period is over. They told us, we are bind and we have legal obligation under the contract. The Salesman lied & deceived us and violated our verbal collateral agreement before contract signing "that we can cancel the contract anytime and refund the 10% downpayment as long as we have not paid yet the 1st monthly amortization which is due May 1st, 2015. Based on our verbal collateral contract prior to signing of written contract, we believed we still have time to rescind the contract, cancel our membership and full refund of our 10% downpayment. We tried our best to informed them our financial situation as honestly as we can to avoid any future conflict but they keep insisting our legal obligation under the contract we signed - that left us no other option than to file a small claims court to get our money back amounting to C$3,540.63, cancel the contract and find our legal rights as a consumer.

Feeling scammed!

I am a Club Intrawest (CI) Member who is considering selling my Club points & ending my membership. Since Diamond Resorts Int'l (DRI) assumed management of the Club (now Embarc by DRI) in November 2015, however, it is unlikely that this will be possible. DRI has the right of first refusal to any Member seeking to sell their membership on the resale market. In fact, DRI prefers that members return their points through forfeit, default of payment or Members even pay DRI to return them! Considering the Club's Repurchase Program? There are over 1,200 CI Members on the waiting list. As Members, we need to be free to set our point price at a fair market value on the secondary market, which we are now prevented to do.

I am writing to invite you to join fellow Club Members, over 1,000 strong, who are united to work together, to inform, educate & campaign against DRI's management of our Club. A Members-only group was launched on Facebook to connect with the 22,000 Members since DRI refused to provide the Membership contact list to facilitate our inter-communication. Also, a website has been created to share key Club documents, explain how the Club is bring managed to benefit DRI, not the Members, provide updates on progress & info on selling points, etc.

Did you know that although we Members own 94% of the Club points & Intrawest/DRI has 6%, the Club instruments were written to give them a weighted voting power of 15 times that of Members (or 48% voting power) in all elections? Did you also know that Intrawest placed their employees in 4 of 5 positions on the Board of Directors, thereby ensuring DRI controls the Board & our Club?
